We investigate claims about the frequency of "know" made by philosophers. Our investigation has several overlapping aims. First, we aim to show what is required to confirm or disconfirm philosophers’ claims about the comparative frequency of different uses of philosophically interesting expressions. Second, we aim to show how using linguistic corpora as tools for investigating meaning is a productive methodology, in the sense that it yields discoveries about the use of language that philosophers would have overlooked if they remained in (...) their "armchairs of an afternoon", to use J.L. Austin’s phrase. Third, we discuss facts about the meaning of "know" that so far have been ignored in philosophy, with the aim of reorienting discussions of the relevance of ordinary language for philosophical theorizing. There is a standard story told about the rise and fall of ordinary language philosophy: it was a widespread, if not dominant, approach to philosophy in Great Britain in the aftermath of World War II up until the early 1960s, but with the development of systematic approaches to the study of language—formal semantic theories on one hand and Gricean pragmatics on the other—ordinary language philosophy more or less disappeared. In this paper we present quantitative evidence to evaluate the standard story (...) of the rise and fall of ordinary language philosophy, building on the topic model of over 30,000 philosophy articles in Weatherson (2022). Using a combination of qualitative judgment and a topic-model-based measurement of similarity between individual articles, we find evidence that supports the first part of the standard story, according to which ordinary language philosophy arises in the 1940s, peaks between the early 1950s and the late 1960s, and then rapidly declines. But we argue that there is also evidence of a "new wave" of ordinary language philosophy in the early 21st century that defies the second part of the standard story. (shrink)

Methodologically rigorous description, analysis, and critique of postmodern phenomena presuppose a rigorous theory of postmodernity, for which the philosophy of Martin Heidegger holds great untapped promise. This essay explicates the basic content of Heidegger’s “metametaphysics,” since for Heidegger a “metaphysics” is the epochally prevailing projection of the meaning of being in general, and he offers a theory of Western metaphysics. I begin with Heidegger’s analysis of the “regional ontologies” of the sciences in his 1927 magnum opus Being and Time, since (...) the metametaphysical works of the “late middle” Heidegger in the 1930s–1940s extend this analytical framework to metaphysics as global ontology. I then explicate Heidegger’s views on modern metaphysics, focusing on his analyses of modern science and the philosophy of Descartes, before turning to his theory of postmodernity, which I extract from his analyses of modern technology and the philosophy of Nietzsche. Rawls famously argues that the parties in the original position would agree upon the two principles of justice. Among other things, these principles guarantee equal political liberty—that is, democracy—as a requirement of justice. We argue on the contrary that the parties have reason to reject this requirement. As we show, by Rawls’ own lights, the parties would be greatly concerned to mitigate existential risk. But it is doubtful whether democracy always minimizes such risk. Indeed, no one currently knows which political (...) systems would. Consequently, the parties—and we ourselves—have reason to reject democracy as a requirement of justice in favor of political experimentalism, a general approach to political justice which rules in at least some non-democratic political systems which might minimize existential risk. For many women experiencing motherhood for the first time, the message they receive is clear: mothers who do not breastfeed ought to have good reasons not to; bottle feeding by choice is a failure of maternal duty. We argue that this pressure to breastfeed arises in part from two misconceptions about maternal duty: confusion about the scope of the duty to benefit and conflation between moral reasons and duties. While mothers have a general duty to benefit, we argue that this (...) does not imply a duty to carry out any particular beneficent act. Therefore, the expectation that mothers should breastfeed unless they have sufficient countervailing reasons not to is morally unwarranted. Recognising the difference between reasons and duties can allow us to discuss the benefits of breastfeeding and the importance of supporting mothers who wish to breastfeed without subjecting mothers who bottle feed to guilt, blame and failure. Abstract: There are epistemic manipulators in the world. These people are actively attempting to sacrifice epistemic goods for personal gain. In doing so, manipulators have led many competent epistemic agents into believing contrarian theories that go against well-established knowledge. In this paper, I explore one mechanism by which manipulators get epistemic agents to believe contrarian theories. I do so by looking at a prominent empirical model of trustworthiness. This model identifies three major factors that epistemic agents look for when trying (...) to determine who is trustworthy. These are (i) ability, (ii) benevolence, and (iii) moral integrity. I then show how manipulators can manufacture the illusion that they possess these factors. This leads epistemic agents to view manipulators as trustworthy sources of information. Additionally, I argue that fact-checking will be an ineffective – or even harmful – practice when correcting the beliefs of epistemic agents who have been tricked by this illusion of epistemic trustworthiness. I suggest that in such cases we should use an alternative correction, which I call trust undercutting. (shrink)

Of the various loci of systematic theology that call for sustained philosophical investigation, the doctrine of sanctification stands out as a prime candidate. In response to that call, William Alston developed three models of the sanctifying work of the Holy Spirit: the fiat model, the interpersonal model, and the sharing model. In response to Alston’s argument for the sharing model, this paper offers grounds for a reconsideration of the interpersonal model. We close with a discussion of some of the implications (...) of one’s understanding of the transforming work of the Holy Spirit for practical Christian spirituality. (shrink)

Abstract: In this paper I argue that luck and fortune are distinct concepts that apply to different sets of events. I do so by suggesting that lucky events are best understood as significant events that are either modally fragile or improbable (depending on whether you accept a modal account or a probability account of luck), whereas fortunate events are best understood as significant events that are outside of our control. I call this the Pure Control Account of Fortune. I show (...) that this account of fortune forces control theorists about luck to be fortune reductionists but allows those who endorse a modal or probability account of luck to be fortune realists. Additionally, I argue that this account of fortune helps us overcome prominent counterexamples and challenges found in the luck literature. (shrink)

This article’s purpose is to defend the depiction of ordinary-sized physical objects as mereological aggregates (MAs), to clarify what the ontology of an MA is, and to show why mereological essentialism (ME) applies to MAs that seem to be ubiquitous if we are to adopt what Frank Jackson calls “Serious Metaphysics” and refuse to broaden our ontology beyond what is (allegedly) bequeathed to us by physics and chemistry. To accomplish this goal, first, I clarify certain background issues that inform what (...) follows and I identify certain constraints that relate to the contemporary ambivalence towards ME. Second, I present a primer on Husserlian mereology that provides a superior account of parts and wholes than the inadequate approach identified in the previous section. Third, I will offer a defense of ME as the correct approach to providing an ontological account of MAs. Finally, I will evaluate two defeaters against my thesis. (shrink)

There are unusual challenges in ethics for RAS. Perhaps the issue can best be summarised as needing to consider “technically informed ethics”. The technology of RAS raises issues that have an ethical dimension, and perhaps uniquely so due to the possibility of moving human decision-making which is implicitly ethically informed to computer systems. Further, if seeking solutions to these problems – ethically aligned design, to use the IEEE’s terminology – then the solutions must be technically meaningful, capable of realisation, capable (...) of assurance, and suitable as a basis for regulation. Thus, ethics for RAS is a rich, complex multi-disciplinary concern, and perhaps more complex than many other ethical issues facing society today. It is also fast-moving. This paper has endeavoured to give an accessible introduction to some of the key issues, noting that many of them are quite subtle, and it is not possible to do them full justice in such a short document. However, we have sought to counterbalance this by giving an extensive list of initiatives, standards, etc. that focus on ethics of RAS and AI, see Annex A. (shrink)

This paper gives a full picture of the moral universe pressuring all sides in the strike by porters in Paris during January 1786. These Parisian day-labourers found their livelihood taken away by a new system of parcel delivery, part of a many-sided endeavour to rationalise the economy. They rioted and were the first rioting mob to appeal to the king at Versailles. This paper looks at the riot from the points of view of the rioters and their neighbours, the police, (...) the investors in the new parcel post scheme and the advancing American trade. This exemplifies a theort of hustoiry that focuses on the moral universes of past actors. (shrink)

Le flâneur parcoure des variations de paysages et d’horizons, comme une séquence imaginative. Il existe une liaison logique entre la marche, le récit, la peinture et le mythe : dans chacun de ces cas, l’imagination est fortement stimulée. Chacun d’entre eux est un moyen de cheminer selon des voies vers une Vérité supérieur. La marche est, (...) pour l’individu, une quête à plusieurs dimensions : quête de connaissances sur le monde, sur soi-même ; quête de sa véritable identité ou quête d’une Vérité supérieure (comme dans le cas des pèlerinages) ; le mythe, la religion, la peinture et l’écriture sont, de même, des expressions des cheminements vers telle ou telle Vérité. Le thème de la marche nous offre donc l’occasion de porter un regard particulier sur l’esprit hétéroclite du voyageur, collectionneur d’objets, de traces. Mais aussi, au contraire, du sujet qui s’évide, comme chez les taoïstes. Cet essai vise réfléchir sur le parcours du voyageur en insistant sur les liens multiples qui président au temps, à l’acte de marcher, et celui de la réflexion esthétique, en spécial, la peinture et la poésie. 1950s witnessed a drastic change in the history of British drama. The publication of John Osborne’s masterpiece, Look Back in Anger in 1956 radicalised the British theatre. The play was a blow against establishment. Osborne portrayed Jimmy Porter, the anti-hero of the play. He is frustrated and malcontent. He attacks the establishment in every sense. Following the success of this play, a generation of writers emerged who are labelled as “angry young men”, though they were not a unified group. (...) This media-created uncommon group included John Osborne, Kinsgsley Amis, John Wain, Collin Wilson, Allan Sillitoe, John Arden, Arnold Wesker and Harold Pinter. Shelagh Delaney, after publication of her successful and rebelling play, A Taste of Honey (1956) had been included in this group but it may not be appropriate to stick the journalistic label “angry young men” to her because she differs from most of them and the label itself obviously implies its patriarchal nature. This “new wave” of British young playwrights had tried to radicalise not only themes but also structures and styles of their plays. Hostile to anything that was “high-brow”, these British playwrights were revolutionary in dealing with working class characters and themes. They rejected the style and subject of educated upper middle class. Expressing the discontent and frustration of the newly educated lower class, they were explicitly and intensely against establishment. Their plays were termed as “Kitchen-Sink” Drama. It was a term that gained popularity in Britain in the middle and late 1950s. The term refers to pays which were set in ordinary domestic settings. They depict lower strata of British society and their struggle to survive in post-war period. According to Collin’s Dictionary, it is a term which refers to a type of drama of the 1950s depicting sordid aspects of domestic reality. (shrink)

In this paper I take up (what I call) the pregnancy loss objection to defenses of abortion that deny fetal moral status. Though versions of this objection have been put forth by others—particularly Lindsey Porter’s in a 2015 paper—I argue that the existing versions of the objection are unsuccessful in various ways: failing to explain the ground of moral considerability that would apply to embryos/fetuses in very early pregnancy, lack of clarity about what it means to take grief after (...) miscarriage seriously, and implausible implications regarding pre-embryo and infertility cases. I go on to offer a more plausible version of the objection, which I apply only to mid-pregnancy and fetuses, by drawing on personal narratives of later pregnancy loss and abortion and emphasizing practices that indicate the relevant kind of mourning. I then take up the question of how experience of the sort I have in mind can function as evidence, by situating my version of the objection in a pragmatist ethical view. Finally I consider and respond to some worries about the very idea of taking experience of pregnancy loss to be evidence regarding fetal moral status. (shrink)

On conçoit souvent la jalousie comme une émotion ayant pour objet les relations de proximité (amour, amitié, fratrie, etc.). Elle a généralement mauvaise presse et est typiquement envisagée comme une émotion moralement condamnable, voire comme un vice. Or, la jalousie ne porte pas uniquement sur les relations de proximité : elle peut également porter sur divers biens (prestige, richesses, biens matériels, privilèges, etc.). Par ailleurs, certains auteurs soutiennent que des cas de jalousie pourraient être moralement justifiés, voire que la (...) jalousie pourrait être une vertu. La jalousie paraît également jouer un rôle dans l’institution et le maintien d’institutions visant à perpétuer des inégalités entre les individus jaloux de leurs avantages et ceux qu’ils envisagent comme des concurrents cherchant à les déposséder de leurs biens. De fait, la jalousie paraît utile pour la théorie politique de par les liens qu’elle entretient avec la justice distributive. Cet article propose, dans la première section, une discussion portant sur la nature de la jalousie où elle est contrastée avec l’envie et l’indignation. Dans la seconde section, on se demandera si la jalousie est un vice, ou si elle peut être parfois moralement justifiée, ou même être une vertu. La troisième section traitera les rôles joués par la jalousie collective dans la justice distributive et la fondation et le maintien d’institutions sociales visant à protéger les intérêts des jaloux. Pour le faire, le cas de la jalousie économique, telle que David Hume et Adam Smith la concevaient dans les relations commerciales entre États européens au XVIIIème siècle, est considéré. (shrink)

The aim of this paper is to argue in favor of the idea that it is possible not only to give a special place to reason in our life and in society, but also to offer an integrative rational framework, in in which human ends and goals find their rational expression. The text has three parts. The first describes Alfred Schutz's practical-hermeneutical approach to law and normativity, while making room for a subjective practice of reason. The second proposes to reveal, (...) through the description of knowledge in the world of ordinary life, a form of rationality which offers us practical but consistent ways of making a decision. Ultimately, the third aims at the practical-hermeneutical reconstruction of the law, in order to integrate into the core of legal reasoning references to ends and purposes without prejudicing the objectivity of the reasoning itself. The study aims to make a contribution to the problem of dedifferentiation and positivism of practice in the modern world. Le but de ce papier est d’argumenter en la faveur de l’idée qu’il est possible non seulement de donner une place particulière à la raison dans notre vie et dans la société, mais aussi d’offrir un cadre rationnel intégratif, dans lequel les fins et buts humains trouvent leur expression rationnelle. Le texte comporte trois parties. La première décrit l’approche pratique-herméneutique d’Alfred Schutz à l’égard de la loi et de la normativité, tout en faisant place à une pratique subjective de la raison. La deuxième se propose de dévoiler, à travers la description de la connaissance dans le monde de la vie ordinaire, une forme de rationalité qui nous offre des voies pratiques mais consistantes de prendre une décision. En fin de compte, la troisième vise la reconstruction pratique-herméneutique de la loi, afin d’intégrer dans le noyau du raisonnement légal des références à des fins et buts sans porter préjudice à l’objectivité du raisonnement lui-même. The history of wine-drinking is a history of excess. From Noah’s disastrous first experiments and the bacchanalia of the ancient Greeks to the spectacular overindulgence described in the diaries of Evelyn Waugh, the consumption of wine to excess has been a recurrent theme among those drink and those who write about it. Sometimes the quantities consumed by the drinkers of the past are staggering. According to Roy Porter’s English Society in the Eighteenth Century, ‘to gain a reputation as a (...) blade one had to be at least a three-bottle man. Sheridan, Pitt the Younger, and the Greek scholar Porson were all said to be six-bottle men’. One cannot help wondering whether they meant the same by ‘bottle’ as we do... (shrink)

Histoire et utilisation du robot Bien que la robotique soit un marché économique relativement jeune et en pleine croissance, la genèse des robots remonte à l’Antiquité. Le premier robot à être déployé sur des lignes d’assemblage est Unimate, utilisé dès 1961 par General Motors. La robotique, en se di usant dans tous les pans de notre économie, va impacter les business modèles de nombreuses industries comme l’automobile et l’aéronautique mais aussi la construction ou l’agriculture. Aujourd’hui les robots industriels et de (...) service servent à de multiples tâches allant de la logistique à l’usinage en passant par la fonderie. La robotique constitue aussi et surtout un enjeu sociétal contribuant à relever les dé s de la mobilité, de la santé, de l’autonomie, du vieillissement et de l’éducation. Absence de dé nition et de régime juridique spéci que au robot En France, la notion de robot ne fait pas l’objet d’une dé nition juridique qui lui est propre. Les dé nitions relatives à l’environnement robotique peuvent tout de même se retrouver dans la norme ISO 8373:2012. Bien que les robots intéressent les juristes à plusieurs titres, le législateur n’a, à ce jour, pas adopté de régime juridique spéci quement applicable aux robots. Il convient donc de rechercher dans le droit positif le corpus de textes applicables aux robots. Ce corpus pourra alors recevoir l’appellation de « droit de la robotique ». Garanties Le vendeur d’un robot industriel et de service doit se conformer aux garanties légales que sont la garantie des vices cachés et la garantie d’éviction. Il doit également respecter les éventuelles garanties qui ont pu être convenues contractuellement Clauses contractuelles Le fournisseur d’un robot industriel et de service doit être particulièrement attentif aux clauses contractuelles rela- tives à la garantie, à la propriété intellectuelle, à la con dentialité, à la responsabilité et à la conformité aux directives techniques. Les spéci cités liées au robot, telles que les éléments relatifs à l’intelligence arti cielle, pourront être intégrées dans des annexes spéci ques. Intelligence arti cielle L’algorithme d’intelligence arti cielle dont est équipé un robot industriel et de service peut, dans certaines condi- tions, béné cier d’une protection grâce au droit d’auteur, à la protection du savoir-faire et au brevet. Aucun régime spécial n’existe à ce jour protégeant les œuvres conçues par le robot intelligent. Mobilité Les véhicules et drones autonomes utilisés au sein même de l’usine sont considérés comme des machines. Etant don- né les risques existants, il convient de xer de règles internes d’utilisation. Les véhicules autonomes ne peuvent à ce jour quitter l’espace privé. En revanche, les drones peuvent circuler dans l’espace aérien en respectant strictement le cadre réglementaire. Douanes Le taux de perception des droits de douanes d’un robot industriel et de service est conditionné par la connaissance de l’origine, préférentielle ou non préférentielle, du robot qui est déterminée par la position tarifaire de ce dernier. Le robot industriel et de service entre dans le chapitre 84, qui concerne notamment les machines, de la nomenclature du système harmonisé établi par l’Organisation mondiale de douanes. Sécurité En application de la « directive machines », le robot peut recevoir la quali cation de machine ou de quasi-machine. En vertu de cette directive, mais également au titre du Code du travail, de nombreuses obligations en matière de santé et de sécurité doivent être respectées pour la commercialisation et l’utilisation des robots. Conformité Le Code du travail, en transposant la « directive machines », a prévu de nombreuses obligations et procédures, appli- cables aux robots industriels et de service, permettant ainsi de s’assurer que ces derniers respectent les exigences de conformité nécessaires en matière de santé et de sécurité. Maintenance Dans le cadre de la maintenance, le fournisseur d’un robot industriel et de service est soumis à plusieurs obligations législatives aux titres de la disponibilité des pièces détachées et de la location. Les dispositions contractuelles de- vront prendre en considération les spéci cités propres au robot et ne pas ignorer la maintenance prédictive. Quali cation juridique Dans le cadre de la conception, de la fabrication et de l’utilisation du robot, il convient de porter une attention par- ticulière à quatre textes spéciaux qui peuvent être applicables aux robots industriels et de service : le règlement 428/2009 sur les biens à double usage, la directive 2014/35/UE applicable au matériel électrique basse tension, la directive 2014/53/UE applicable aux équipements radioélectriques et la directive 2014/30/UE sur la compatibilité électromagnétique. Responsabilité Bien que les régimes de responsabilité, civile et pénale, ne sont pas adaptés aux robots autonomes, la responsabilité civile de droit commun, la responsabilité du fait des choses, la responsabilité du fait des produits défectueux et la responsabilité des commettants du fait de leurs préposés peuvent s’appliquer en cas de fait dommageable causé par le robot tout comme la responsabilité pénale en cas d’infraction commise dans le cadre de l’utilisation du robot. Assurance La police d’assurance relative aux robots doit permettre de protéger le robot contre les risques auxquels ils sont confrontés mais également d’assurer la responsabilité pour les dommages qu’ils pourraient causer, on peut alors parler de « dommages robotiques ». Données et bases de données Les bases de données contenues dans un robot industriel et de service doivent respecter les droits dont dispose l’auteur sur la structure de la base de données et/ou les droits du producteur des bases de données dans lesquelles gurent les données utilisées. La réglementation Informatique et libertés est également applicable au robot lorsque celui-ci collecte et/ou traite des données personnelles. Droit de la robotique dans le monde Aucun Etat ne s’est à ce jour doté d’un régime juridique détaillé et spéci que à la robotique. Des dispositions juri- diques relatives aux robots peuvent tout de même se retrouver de façon éparse dans certains droits étrangers concer- nant notamment les drones et les véhicules terrestres autonomes. Much of the literature from political psychology has focused on the negative traits that are positively associated with affective polarization—e.g., animus, arrogance, distrust, hostility, and outrage. Not as much attention has been focused on the positive traits that might be negatively associated with polarization. For instance, given that people who are intellectually humble display greater openness and less hostility towards conflicting viewpoints (Krumrei-Mancuso & Rouse, 2016; Hopkin et al., 2014; Porter & Schumann, 2018), one might reasonably expect them to (...) be less polarized. -/- We ran two studies designed to explore the relationship between various forms of humility and polarization. Our chief finding is that people who value humility are prone to what we are calling epistemic polarization—that is, judging the epistemic traits of contrapartisans negatively—which in turn plays a role in polarization more generally. Not only are contrapartisans deemed to have the wrong moral and political beliefs, they are also viewed as less humble and more arrogant, close-minded, and irrational. This makes matters even worse when it comes to the growing partisan divide. In light of our findings, we believe that the novel concept of epistemic polarization that we introduce is a promising target for further investigation. (shrink)

Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. In the theoretical framework developed by Y. Lenoir and his colleagues, Bourdieu’s concept of habitus is fundamental to explaining the tacit aspect of teaching practices. This article takes a critical look at the connection the framework makes between the concept of habitus and that of embedded skills, which is derived from French ergonomic psychology. Our primary objective is to examine the relevance and the limitations of this connection, with specific focus on its methodological implications. Our results indicate that a cognitive (...) interpretation of the concept of habitus may contribute significantly to understanding the implicit aspect of professional practices. Frontiers of Justice: Disability, Nationality, Species Membership, by Martha Nussbaum, Harvard University Press, 2006. How should we measure human development? The most popular method used to be to focus on wealth and income, as when international development agencies rank countries according to their per capita gross domestic product. Critics, however, have long noted shortcomings with this approach. Consider for example a wealthy person in a wheelchair: her problem is not a financial one, but a lack of access to public spaces. (...) Even if she were to hire porters to carry her in and out of stores and libraries, that would not really address her situation. There is a basic sense of dignity and self-respect that comes with being able to move around on one’s own. Even for a disabled millionaire, that will only be possible when public buildings are wheelchair accessible. To fully grasp what the handicapped need, we have to look beyond purely economic measures of well-being, and take into account the actual capabilities people can exercise in their daily lives. The example of the well-off person in a wheelchair illustrates what Martha Nussbaum calls the capabilities approach to human development. It was first pioneered in economics by Amartya Sen (who came up with the wheelchair example), and Nussbaum has for years been associated with a more philosophical variation, which uses the idea of capabilities to outline basic political principles. In Frontiers of Justice: Disability, Nationality, Species Membership Nussbaum takes this project even further, and applies the capabilities approach to issues of justice involving not only the disabled and the global poor, but animals as well.Yet for a philosophy called the capabilities approach, it is surprising how little theoretical work capabilities do in Nussbaum’s overall account. The trial took place at Bristol Crown Court, England, United Kingdom for the murder of Joanna Yeates, and Dr Vincent Tabak was the Defendant. The author attended at court for this trial and this paper notes many of the obvious and unsatisfactory legal and procedural points in this trial. Dr Vincent Tabak was convicted of the murder at this trial. Of course the jury were not to know the finer points of law as the lower court judge did not advise (...) the jury of any such points before they adjourned to make their decision. All but one concluded that Dr Tabak was guilty as charged, although even the charge was vague and all-encompassing as he was charged with ‘murder between Friday 17 December 2010 and Sunday 19 December 2010’. Defence counsel, very eminent barrister-at-law, appeared to be cowed by the other side and let them walk all over this case procedurally. For example, prosecution counsel handed him 1200 pages of evidence on the first day of the trial, as if to FULFIL disclosure obligations. E was stunned and asked the court for time off. But this was never again discussed. -/- The lower court judge appeared as if he had already decided on the case. When Defence Counsel asked him if he had before him a copy of a certain document, he flippantly say he had it but had left it on his desk in his room. When Defence Counsel, of international renown, was ready to present his opening speech and cross-examination of his client, Dr Vincent Tabak, this lower court judge dismissed the jury to their lunch break knowing that counsel was going to speak. Court had to be adjourned and the members of the jury quickly assembles by the court porters as they were leaving the court, which must have hampered their interest in what counsel’s statement said. A photograph of a dead body by a roadside, allegedly, Miss Yeates, was shown by projector slide a dozen irrelevant times during the trial period, thus embedding that photograph in the jury’s mind. The computer evidence leaves much to be desired and could, some suggested, easily have been concocted by the prosecution team, abusing the law of metadata evidence. Te lady who presented it did not give the court her qualifications and her expertise if any- and much more that beggars belief and loses trust in the British Criminal Justice System, such as it is, following ‘form over substance’. -/- . The study aims to identify the efficiency of the university education performance from the perspective of postgraduate and undergraduate students in international and Palestinian universities. The analytical descriptive approach was used for this purpose and the questionnaire was used as a main tool for data collection. The study community consists of: post graduate students, (23850) graduate students and (146355) undergraduate students. The sample of the study was 378 graduate students and 383 undergraduate students. The random stratified sample was used. The (...) Statistical Package of Social Sciences (SPSS) was also used for data analysis. The study reached a number of results, the most important of which are: The level of efficiency of educational performance in Palestinian and international universities from the point of view of postgraduate and undergraduate students was high. And that there are significant differences between the average views of the sample of the study on the efficiency of educational performance in Palestinian and international universities attributed to the University and to the benefit of international universities. The study concluded many recommendations, the most important of which is the necessity of continuing to develop e-learning strategies that affect the efficiency of educational performance and research commensurate with the university's position in the local and international community, which puts it on the best classification between local and international universities through e-learning. Tomatoes are plants grown in temperate and hot regions of South American origin from Peru, and then spread to most countries of the world. Tomatoes contain a lot of vitamin C and mineral salts, and are recommended for people with constipation, diabetes and patients with heart and body diseases. Studies and scientific studies have proven the importance of eating tomato juice in reducing the activity of platelets in diabetics, which (...) helps in protecting them from developing deadly blood clots. A tomato classification approach is presented with a data set containing approximately 5,266 images with 7 species belonging to tomatoes. In this paper, we present an intelligent tutoring system developed to help students in learning Computer Theory. The Intelligent tutoring system was built using ITSB authoring tool. The system helps students to learn finite automata, pushdown automata, Turing machines and examines the relationship between these automata and formal languages, deterministic and nondeterministic machines, regular expressions, context free grammars, undecidability, and complexity. During the process the intelligent tutoring system gives assistance and feedback of many types in an intelligent manner according to (...) the behavior of the student. Several prominent theorists have recently advocated reconceptualizing rape as “nonconsensual sex,” omitting the traditional “force” element of the crime. I argue that such a conceptualization fails to capture what is distinctively problematic about rape for women and why rape is pivotal in supporting women’s gender oppression. I argue that conceptualizing rape as coerced sex can replace both the force and nonconsent elements and thereby remedies some of the main difficulties with extant definitions, especially in recognizing “acquaintance” rape as such. Every person has his/her own unique signature that is used mainly for the purposes of personal identification and verification of important documents or legal transactions. There are two kinds of signature verification: static and dynamic. Static(off-line) verification is the process of verifying an electronic or document signature after it has been made, while dynamic(on-line) verification takes place as a person creates his/her signature on a digital tablet or a similar device. Offline signature verification is not efficient and slow for a (...) large number of documents. To overcome the drawbacks of offline signature verification, we have seen a growth in online biometric personal verification such as fingerprints, eye scan etc. In this paper we created CNN model using python for offline signature and after training and validating, the accuracy of testing was 99.70%. Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. The second law of thermodynamics, written as an equation of motion, reveals that elemental abiotic matter evolves from the equilibrium via chemical reactions that couple to external energy towards complex biotic non-equilibrium systems. Each time a new mechanism of energy transduction emerges, e.g., by random variation in syntheses, evolution prompts by punctuation and settles to (...) a stasis when the accessed free energy has been consumed. The evolutionary course towards an increasingly larger energy transduction system accumulates a diversity of energy transduction mechanisms, i.e. species. The rate of entropy increase is identified as the fitness criterion among the diverse mechanisms, which places the theory of evolution by natural selection on the fundamental thermodynamic principle with no demarcation line between inanimate and animate. I argue that God lacks the standing to blame or punish people for their sin if theological determinism is true, and that this is so even if sinners deserve both blame and punishment for sins God determines them to commit (and thus even if theological determinism is compatible with human free will and moral responsibility). I then respond to two recent objections to this conclusion, one by John Ross Churchill, the other by Patrick Todd. I conclude by noting several implications (...) of the position here defended. Social dimension of moral responsibility has started to gain more attention in moral philosophy, be it within the network of action theory, or any other meta-ethical domain. Although there are many social acts and therefore social dimensions of responsibility, I aim to indicate one aspect of sociality in our thinking and practice, particularly in our moral thinking, that is the thick concepts. In this work, I consider Vargas’s concept moral ecology (2015, 2018) as a tool to understand certain social aspects (...) of moral responsibility, while claiming to extend his line of thinking in moral ecology by giving a more active role to the individual agent within the ecology that she is engaged in. I claim that when we understand the relationships between the agent and her surrounding ecology in a more complex, and under certain circumstances in a rather reciprocal way, we can have a better and more nuanced understanding of non-ideal moral landscapes that we are engaged in, while maintaining a certain kind of responsibility to the agents in their social environments. I will use the term niche construction and niche selection – concept that are already at use within the similar biological line of thought within action – to refer to such situations where agents are actively shaping their environments. Posteriormente, examinaremos el lugar que tiene el (...) alma en los argumentos de Platón y Aristóteles en favor de esclavitud, con énfasis en el papel de la mirada, el dominio sobre el cuerpo y la naturaleza de los cuerpos esclavizables. Finalmente, revisaremos en la obra de Frantz Fanon una crítica a la mirada europea y occidental que diseca el cuerpo negro al otorgarle un alma. -/- ENG: The concept of the soul in the philosophies of Plato and Aristotle, due to the posi-tion it occupies in their arguments concerning slavery, will be central to the ideo-logical structure on which the institution of slavery was sustained during colonial times. It will be important to refer, at first, to Erwin Rohde’s study of this concept, to examine the materiality of the breath and to propose a relationship between the gaze and the configuration of imaginaries. We will then examine the position of the soul in Plato’s and Aristotle’s arguments in favor of slavery, emphasizing the role of the gaze, the dominion over the body, and the nature of enslaved bodies. When looking at a scene, observers feel that they see its entire structure in great detail and can immediately notice any changes in it. However, when brief blank fields are placed between alternating displays of an original and a modified scene, a striking failure of perception is induced: identification of changes becomes extremely difficult, even when changes are large and made repeatedly. Identification is much faster when a verbal cue is provided, showing that poor visibility is not the cause of (...) this difficulty. Identification is also faster for objects mentioned in brief verbal descriptions of the scene. These results support the idea that observers never form a complete, detailed representation of their surroundings. In addition, results also indicate that attention is required to perceive change, and that in the absence of localized motion signals it is guided on the basis of high-level interest. (shrink)

The study aimed to identify the delegation of authority for the performance of the medical staff and its relationship to improving the quality of health care in Al-Shifa Medical Complex in the southern Palestinian governorates. The question I want to explore is whether experience supports an antireductionist ontology of time, that is, whether we should take it to support an ontology that includes a primitive, monadic property of nowness responsible for the special feel of events in the present, and a relation of passage that events instantiate in virtue of literally passing from the future, to the present, and then into the past.

Disagreement is common: even informed, intelligent, and generally reasonable people often come to different conclusions when confronted with what seems to be the same evidence. Can the competing conclusions be reasonable? If not, what can we reasonably think about the situation? This volume examines the epistemology of disagreement. Philosophical questions about disagreement arise in various areas, notably politics, ethics, aesthetics, and the philosophy of religion: but this will be the first book focusing on the general epistemic issues arising from informed (...) disagreement. Neuron diagrams are heavily employed in academic discussions of causation. Stephen Mumford and Rani Lill Anjum, however, offer an alternative approach employing vector diagrams, which this paper attempts to develop further. I identify three ways in which dispositionalists have taken the activities of powers to be related: stimulation, mutual manifestation, and contribution combination. While Mumford and Anjum do provide resources for representing contribution combination, which might be sufficient for their particular brand of dispositionalism, I argue that those resources are not (...) flexible enough to further accommodate either stimulation or mutual manifestation. Representational tools are provided to address these limitations, improving the general value of the vector model for dispositionalist approaches to causation. (shrink)

The article studies the impact of Fintech on entrepreneurship in Arabic region by using Crowdfunding platforms as the field of study. The article focuses on Arabic Crowdfunding platforms. This study investigated the impact of investor psychological bias on a firm’s market value. In detail, we examined the effect of investor overconfidence (optimism) and loss aversion (pessimism) on firm market value. We also aimed to investigate the moderating effect of corporate governance on the relationship between investor behavior biases and firm market value. This study used a sample of 143 firms listed on the Saudi Stock Exchange over the period from 2012 to 2021. The results suggest that investor overconfidence (...) affects a firm’s value positively. On the other hand, loss aversion is negatively associated with the firm’s market value. Furthermore, we find that corporate governance (measured by board size and board independence) enhances the positive association between overconfidence and firm market value. In contrast, we find that corporate governance seems to marginally mitigate the negative effect of loss aversion. (shrink)

Abstract: The study aimed to determine the strategic flexibility and its relationship to the level of quality of services provided, from the viewpoint of the internal beneficiary in non-governmental hospitals in Gaza Strip. The study relied on the descriptive and analytical approach, and the questionnaire was designed as a tool to collect data and consisted of (39) items, and the researchers used the comprehensive survey method, and the number of the study population was (536) individuals, where (434) questionnaires were retrieved, (...) and the recovery rate was (80.97%). The study revealed many results, the most important of which were: the existence of a moderate degree of approval by the study sample individuals on strategic flexibility, as it was evident through the area of strategic flexibility as a whole having a relative weight (60.44%). The study is on the quality of services, as it became clear through the field of service quality obtaining a relative weight (79.90%). The results of the study revealed a statistically significant relationship between strategic flexibility and the quality of services in non-governmental hospitals in Gaza Strip, with a correlation coefficient of 0.490. The study reached many recommendations, the most important of which were: the need to work on appointing young people and those with potentials, because jobs are vacant in the hospitals under study, and the need to seek the help of an administrative staff with scientific and practical qualifications, and to work on updating information systems, archiving and networks through which data and information are transferred between departments And the creation of mechanisms by which stored information can be used to enhance the decision-making process, and an effective system to receive patients' complaints in a manner that ensures rapid response and treatment, to achieve continuous communication between patients and the hospital management, and to notify patients of dealing with the complaints they submit, and work to provide all Medical and health specialties in the hospitals under study, by making use of the medical delegations that visit Gaza Strip, involving them in the treatment processes, bringing in doctors and specialists from abroad, updating the standards related to measuring the services provided to patients on an ongoing basis, based on the suggestions and complaints of patients, and developing facilities in hospitals As well as updating the medical devices and equipment used in hospitals periodically. Abstract: This research paper presents a novel approach to predict audit risks using a neural network model. The dataset used for this study was obtained from Kaggle and comprises 774 samples with 18 features, including Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, History_score, score, and Risk. The proposed neural network architecture consists of three layers, including one input layer, one hidden layer, and one output layer. The neural network model was trained and validated, achieving (...) an impressive accuracy of 100% and an average error of 0.000015, indicating its robust predictive capability. Moreover, we conducted feature importance analysis to identify the most influential features for predicting audit risk. The key features found to be critical for classifying fraudulent activities in audit risk prediction are Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, and History_score. This research contributes to the field of audit risk prediction by demonstrating the effectiveness of a neural network-based approach and highlighting the importance of specific features in detecting fraudulent activities. The findings have significant implications for auditors and organizations seeking to enhance their audit risk assessment processes, ultimately leading to improved financial transparency and fraud detection.
